Beyond standard trademarks, collective marks are used by guilds or associations for shared objectives, while certification marks authenticate quality, origin, or characteristics under neutral ownership.

Registered vs Unregistered Rights

IP rights are territorial. A registered trademark grants monopoly use with the ® symbol; pending applications may use ™. Breach of an unregistered mark is addressed through passing-off (civil remedy); registered mark breach constitutes infringement with civil and criminal remedies available.

Classification and Registration

Goods and services are classified under the international Nice system — 45 classes (34 for goods, 11 for services). Applications may cover one or multiple classes. Under Indian law, a mark may be registered before trade begins and remains valid for five years without use; marks in use may be registered at any time.

Strong vs Weak Marks

Absolute and relative grounds determine registrability. Descriptive or commonly used terms tend to be weak; coined words or original artwork typically form strong, defensible marks. Registered trademarks renew every ten years and may be renewed indefinitely while in use.
